The bill submitted to the State Duma provides for measures that, according to the authors, will ensure the protection of the child, but will not allow him to be taken from the family without a court decision. The document may be considered in autumn from a family without trial” />
A bill on measures to protect children, which would help avoid their removal from families, will be considered during the autumn session. Andrei Klishas, a member of the Federation Council Committee on Constitutional Legislation and State Construction, announced this on Telegram.
“A set of measures to protect children is proposed, commensurate with the threats that must be eliminated, while maintaining the child's right to a family of his own. The removal of a child should be considered as an exceptional measure for the protection of the child and be applied only on the basis of a court decision, — said the senator.
Now Article 77 of the Family Code of Russia gives the body of guardianship and guardianship the right to immediately take the child away from the parents or guardians in the event of a threat to the life or health of the child.
Also, according to Klishas, the law will include “the presumption of good faith in the exercise of parental rights by parents” as a principle of family law regulation, as well as the right of the child to live and be raised in his own family.
“The bill was prepared with the active participation of representatives of the parent community. We look forward to a constructive dialogue with all parliamentary factions on this bill during the autumn session of the parliament,— wrote Klishas.
Co-author of the bill, head of the subcommittee on civil and family law of the Committee of the Federation Council on constitutional legislation and state building Elena Mizulina said that the document had already been submitted to the State Duma and with its help, legislators would like to exclude the practice of arbitrary removal of children from families in Russia.
